Terms and Conditions of Participation for the raffle „Yourope International Festival Survey“
As part of the online survey „Yourope International Festival Survey,“ Höme – Für Festivals GmbH c/o Bildau & Bussmann, Gerichtstrasse 23, 13347 Berlin (hereafter referred to as „Höme“) is conducting a raffle in accordance with these terms and conditions of participation. The raffle is not connected to the company Typeform.
In the survey within the project „Yourope International Festival Survey,“ festival visitors are invited by Höme, Yourope, and other partners to share their experiences, thoughts, and assessments about Festivals. By participating in this survey, festival visitors (hereafter referred to as „Participant“) have the opportunity to participate in a raffle under the following conditions. By participating in this raffle, participants accept these terms and conditions of participation.
1. Participation
1.1 The raffle will be held from 01.09.2024, 00:01 to 30.09.2024, 23:59. Participation requires registration at https://form.typeform.com/to/IVZYheLp, is free of charge except for any usage fees for the internet connection, and is not tied to any remuneration obligation. Participants must be at least 18 years old. Participation can only take place via the internet. Eligible participants are those residing in the European Union. Employees of Höme, Yourope, and participating festivals and their relatives are excluded from the raffle. Höme reserves the right to adapt, change, or terminate the raffle if necessary.
1.2 In case of a violation of these terms and conditions, especially in cases of false information, manipulation, or other unauthorized actions, Höme reserves the right to exclude the participant from the raffle. In such cases, prizes may be subsequently revoked and reclaimed.
2. Data Protection, Personal Data
By registering for the raffle, the participant agrees that any personal data may be processed and used for the purpose of conducting the raffle; otherwise, participation in the raffle is not possible. The privacy policy of Höme, which can be viewed here, applies to the participation and conduct of the raffle accordingly.
3. Prize, Course of the raffle
3.1 The Prize Höme will determine a winner from among the participants of the online survey by random selection.
3.1 a) The winner will receive 2x festival tickets including camping for all festivals participating in the survey and indicating to Höme their support for the raffle (maximum 10 different festivals). Additionally, the winner will receive a travel budget of up to €500, the form of which will be determined by Höme (e.g., a voucher for a specified travel portal/provider). The prize must be redeemed between 01.01.2025 – 31.12.2025.
3.2 Participation in the raffle occurs according to the following procedure:
a) All users who participate in the online survey and explicitly indicate that they wish to participate in the raffle will be entered into a drawing.
b) The winner will be randomly selected from the participants after the end of the raffle; the drawing will include all entries in the pool.
c) The winner will be notified by Höme via the provided email address by 31.10.2024; if the winner does not respond to the sender of this email within 10 business days, the prize may be transferred to another participant at Höme’s discretion.
d) Höme will coordinate with the winner on the details for redemption (selection of festivals, etc.) through personal communication via phone and/or email.
e) Cash payout of the prize is not possible.
f) The prize claim is not transferable; tickets or voucher cannot be passed on or sold. Admission to a festival is not guaranteed and depends on availability.
g) All participant information will be recorded and stored for the purpose of determining the winner. All personal data will be deleted no later than 30 days after the end of the raffle.
4. Liability
4.1 All information is provided without guarantee. Höme is liable for damages – regardless of the legal basis – only in cases of intent and gross negligence by Höme, its legal representatives, or agents, as well as in cases of culpable violation of essential contractual obligations. Essential contractual obligations are those that make the execution of the raffle possible and on which the participant could rely. In cases of slight negligence in the violation of essential contractual obligations, liability is limited to the typical, foreseeable damage at the time of using the website.
4.2 The above limitation of liability does not apply to damages culpably caused by Höme, its legal representatives, or agents resulting from injury to life, body, or health, as well as for liability under the Product Liability Act.
5. Miscellaneous
5.1 The law of the Federal Republic of Germany applies.
5.2 Should any provision of these terms and conditions be invalid or become invalid, the validity of the remaining terms and conditions remains unaffected.
5.3 Höme reserves the right to change the terms and conditions of participation, provided such changes are legally permissible.
5.4 Höme reserves the right to discontinue, supplement, or change the raffle with reasonable notice, or without notice for important reasons, while reasonably safeguarding the interests of the participants.
5.5 Legal recourse is excluded.
