General Terms and Conditions for End Customers of the Organizer
(Version: 1 October 2026)

1. General Provisions
1.1 These General Terms and Conditions („GTC“) form part of the agreement between +NAMEANDADDRESS+ („Organizer“) and the purchaser („End Customer“) of access, participation, admission or attendance authorizations or reservations and vouchers therefor, or similar or related rights („Tickets“), or other offers, products and services (e.g. merchandise) (together „Offers“) distributed by the Organizer via services operated by Höme. End Customers within the meaning of these GTC also include persons who have not purchased Tickets or other Offers directly from the Organizer but are entitled to participate in an event (e.g. through secondary acquisition, where permitted).
1.2 All communications to the Organizer must be addressed to:

+ADDRESS+

1.3 Höme – Für Festivals GmbH, c/o Bildau & Bussmann GmbH, Gerichtstrasse 23, 13347 Germany („Höme“) provides the Organizer with a technology platform and additional services („Höme Services“) for the distribution of Tickets and other Offers as well as the processing of related transactions. Höme is neither the Organizer nor a ticket broker. During the ordering process, Höme acts exclusively in the name and as representative of the Organizer.

2. Conclusion of the Agreement with the Organizer, Ticket Processing by Höme
2.1 Upon successful completion of a purchase transaction for Tickets or other Offers, an agreement is concluded exclusively between the Organizer and the End Customer. The Organizer is supported by Höme in the processing of orders and payments. Ticket distribution, the Tickets themselves or other Offers are therefore marked with additions such as „powered by Höme“ and/or with services operated by Höme, such as „infield“, and are offered by Höme on these platforms on behalf of the Organizer. No purchase, service or other agreements regarding the acquisition of Tickets and the event or related services are concluded between the End Customer and Höme.
2.2 The End Customer has no entitlement to the conclusion of an agreement with an Organizer. The End Customer acknowledges that the Organizer may make the conclusion of an agreement conditional upon the End Customer’s acceptance of additional terms and conditions, privacy policies, withdrawal information and other contractual components as well as further restrictions (e.g. maximum number of Tickets for an event). The Organizer and Höme (acting on behalf of and as representative of the Organizer) are entitled to refuse or reject the completion of purchase transactions with an End Customer without stating reasons.
2.3 The End Customer acknowledges that the total purchase price of a purchase transaction may be determined or changed solely by the Organizer and may exceed the Ticket price shown on a Ticket or in the ticket shop. The total purchase price is calculated from the stated Ticket price plus any applicable fees and taxes. The total purchase price payable by the End Customer will be communicated to the End Customer before completion of the ordering process. Payment of the total purchase price may be made exclusively via the payment methods made available by Höme (acting on behalf of and as representative of the Organizer).
2.4 The agreement between the Organizer and the End Customer is concluded only upon the corresponding confirmation being sent to the End Customer by Höme (acting on behalf of and as representative of the Organizer) (e.g. by sending the transaction confirmation or allocating and subsequently sending a Ticket with a corresponding Ticket ID). Merely completing the ordering process does not constitute the conclusion of an agreement and does not entitle the End Customer to participate in an event.
2.5 If, due to technical problems, Ticket allocations (both the total allocation for the event and allocations for individual Ticket categories) have been exceeded, the Organizer or Höme (acting on behalf of and as representative of the Organizer) will inform the End Customer thereof. The Organizer or Höme (acting on behalf of and as representative of the Organizer) may cancel the relevant Tickets and refund the corresponding total purchase price.

3. Form of Tickets
3.1 Unless otherwise communicated by the Organizer or Höme (acting on behalf of and as representative of the Organizer), the End Customer will receive from Höme (acting on behalf of and as representative of the Organizer) an automated email confirming the order and another email containing a link to the Tickets purchased for the relevant event. The form in which the Tickets are provided depends on the admission and access arrangements used by the Organizer for the respective event and will be communicated to the End Customer (e.g. download and print, digital wallet, infield App Wallet, etc.). To participate in an event, the Ticket must be presented in the form communicated. Presentation of the order confirmation email alone (without presentation of the Ticket in the respective correct form) does not entitle the End Customer to participate in an event.
3.2 If provided for by the Organizer, the End Customer has the option to order printed and dispatched Tickets for a fee („Hard Tickets“).
3.3 The End Customer is obliged to check a Ticket after delivery or receipt for correctness with regard to quantity, price, date, event, venue and other essential characteristics. Any complaint regarding incorrect Tickets must be submitted to the Organizer or Höme (acting on behalf of and as representative of the Organizer) without undue delay, and no later than five business days after delivery or receipt of the Ticket.
3.4 Ownership of Tickets or rights derived therefrom is transferred to the End Customer only upon full payment of the total purchase price or settlement of all outstanding claims.
3.5 During the purchase transaction, the End Customer must provide truthful, complete and correct information. The Organizer or Höme (acting on behalf of and as representative of the Organizer) are entitled to verify the information provided by the End Customer by appropriate means (e.g. a credit check).

4. Payment via Payment Service Provider „STRIPE“
4.1 The End Customer’s payment is processed exclusively via the external payment service provider Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland (hereinafter „STRIPE“) and its payment system STRIPE Checkout (available at: https://stripe.com/de/legal/consumer), subject to STRIPE’s privacy policy (available at: www.stripe.com/de/privacy). The End Customer may choose between various payment methods such as credit card (Visa, Mastercard, American Express, Discover, Diners Club, China UnionPay), Apple Pay, Google Pay, PayPal, Giropay, etc. Changes, additions and the discontinuation of certain payment methods are expressly reserved.
4.2 Where the „PayPal“ payment service is offered, payment processing is carried out via PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg, whereby PayPal may also make use of the services of third-party payment service providers for this purpose.
4.3 Payments are subject to the General Terms and Conditions of the respective payment service provider, which is the sole recipient of the payment. Neither the Organizer nor Höme accepts payments from the End Customer.

5. Rights and Obligations
5.1 The Organizer informs the End Customer about the essential characteristics of the event or other Offer, in particular its content, location, time, price including fees and taxes, participation requirements, access regulations and, where applicable, accessibility, seating, house rules and other essential restrictions. Höme may provide this information on behalf of the Organizer.
5.2 The information and conditions provided during the booking process for the specific Ticket or Offer become part of the agreement insofar as they apply to the conclusion of the agreement and the performance of the event or Offer.
5.3 It is the sole responsibility of the End Customer to verify whether they are able and willing to meet the requirements, conditions, provisions and regulations necessary for participation. In the event of non-compliance or failure to observe such requirements, the Organizer may refuse or terminate participation in or attendance at an event.
5.4 If there is a suspicion of misuse or a violation of statutory provisions, these GTC or other provisions or requirements of the Organizer (e.g. through fraudulent, illegal or bad-faith activities), or of corresponding circumvention or attempted circumvention, the Organizer or Höme (acting on behalf of and as representative of the Organizer) may revoke the validity of a Ticket without compensation before or during an event and refuse the End Customer the right to participate in an event or remove the End Customer from the event.
5.5 Damage to, loss of or seizure of Tickets must be reported by the End Customer to the Organizer and Höme without undue delay. If the End Customer loses a Hard Ticket or it is lost within the End Customer’s area of responsibility, neither the Organizer nor Höme is obliged to provide a replacement.
5.6 Unless otherwise agreed, the validity of a Ticket is limited to the respective event (in particular with regard to location and time) and, where applicable, to the respective seat or seating unit or the corresponding Ticket category. Once the event has taken place, the Ticket loses its validity.
5.7 The Organizer is responsible for the content, performance, modification, interruption, cancellation or postponement of an event as well as the information provided in this regard. Höme is not obliged to verify or monitor the information provided by the Organizer or the Organizer’s fulfilment of its obligations towards End Customers. Mandatory statutory claims remain unaffected.
5.8 The End Customer further acknowledges that Höme does not guarantee uninterrupted availability and usability of the Höme Services. Höme assumes no liability for delays or errors in transmission, storage failures and associated limitations of the Höme Services. It is pointed out that temporary interruptions of the website and/or individual Höme services may occur in the course of maintenance work.

6. Transfer of Tickets
6.1 Tickets may be resold at no more than the Ticket price stated on the Ticket. Commercial transfer (e.g. as part of a prize draw or for advertising purposes) is prohibited without the prior written consent of the Organizer or Höme (acting on behalf of and as representative of the Organizer). The Organizer must be contacted to change the personalization of personalized Tickets. A processing fee may apply. Höme may cooperate with partner platforms for the resale of Tickets; the terms and conditions of the respective provider apply.
6.2 Where Tickets are resold via the resale function provided on this website, the following conditions apply:
6.2.1 The resale function is available only for Tickets that were properly purchased from the Organizer via the Höme Services (the so-called secondary market). The Organizer reserves the right to restrict or exclude the resale function for individual events, Ticket types and categories or at certain times, in particular due to contractual requirements imposed by partners (e.g. artists, venues) or official requirements. There is no entitlement to cancellation or resale of Tickets.
6.2.2 By listing a Ticket on the secondary market, the selling End Customer („Original Purchaser“) makes a binding declaration that they will return or sell the Ticket to the Organizer at the original Ticket price (face value) or at the price determined in accordance with Section 6.2.3 („Secondary Market Price“) as soon as another End Customer („Secondary Purchaser“) purchases the Ticket. In the event of a successful resale, the Organizer transfers the Ticket to the Secondary Purchaser. The Ticket originally issued to the Original Purchaser is cancelled or invalidated, while a new Ticket is created for the Secondary Purchaser.
6.2.3 The Organizer may specify fixed prices or a price range for the resale of Tickets. Additional fees may apply to the resale.
6.2.4 The Organizer reserves the right to control the order in which Tickets offered directly by the Organizer and Tickets offered via the resale function („Secondary Market Tickets“) are sold. In particular, Tickets that are still available may be sold first before Secondary Market Tickets are offered for sale. Where several Secondary Market Tickets for the same area or category (e.g. standing sections) are available, the Secondary Market Tickets to be offered for sale are selected according to a non-discriminatory factor determined by the Organizer, which takes into account, among other things, the time at which the Ticket was listed on the secondary market.
6.2.5 The End Customer will be informed by email about the status of the Ticket offered for resale. In particular, after a Ticket has been successfully listed on the secondary market, the Original Purchaser receives confirmation by email. The Original Purchaser may remove the Ticket from the secondary market at any time until the Ticket is in the shopping cart of a Secondary Purchaser. If a Ticket offered for resale is not sold (e.g. because the event has passed or due to cancellation), the Original Purchaser will receive corresponding notification.
6.2.6 Following a successful resale, the Organizer pays the Secondary Market Price plus any applicable fees to the Original Purchaser. Payment is made in accordance with the agreed payment method.
6.2.7 A Ticket purchased via the resale function may be offered for resale again by the Secondary Purchaser via the resale function in accordance with the provisions of this Section 6. The same requirements and conditions as for the Original Purchaser apply in this respect.
6.3 In the event of a violation, the Organizer or Höme (acting on behalf of and as representative of the Organizer) may demand payment of a contractual penalty of EUR 500 per Ticket from the End Customer and may refuse admission to an event for the relevant Tickets without replacement. Further claims for damages remain unaffected.

7. Withdrawal, Other Cancellation, Refund, Return, Exchange
7.1 Without a material change to the event:
As a general rule, a Ticket cannot be returned, cancelled or exchanged. For contracts relating to leisure events with a specific date or period, there is no right of withdrawal to the extent provided by law. Statutory rights in the event of cancellation, material modification or postponement of the event remain unaffected.
7.2 In the event of material changes, postponement or cancellation of the event:
In the event of a material change, postponement or cancellation due to circumstances for which the Organizer is not responsible, the Organizer may make the Ticket valid for another event. If participation in this event is unreasonable for the End Customer, the End Customer may request reimbursement of the Ticket price.
7.3 Other cases: In all other cases of a material change, postponement or cancellation, the End Customer may return the Ticket and request reimbursement of the Ticket price. Statutory claims remain unaffected.
7.4 „Material Change“: A change is material within the meaning of this Section 7 if the modified event differs fundamentally from an event that the Ticket purchaser may reasonably be expected to anticipate.
7.5 Review of cancellation and refund requests in the event of irregularities: For every cancellation or refund request, the End Customer must provide all information necessary for the review completely, correctly and truthfully and must submit the requested suitable supporting evidence insofar as its submission is necessary and reasonable in the individual case for reviewing the asserted claim. This applies in particular to the stated reason for cancellation, the time at which it occurred and the person or booking affected by it.
7.6 If there are specific, objective indications of abusive, automated or coordinated claims for refunds, the Organizer or Höme acting on behalf of the Organizer may subject the relevant request to an appropriate individual review and may request additional, objectively necessary supporting evidence for this purpose. Such indications may arise in particular from contradictory or clearly implausible information, repeatedly similar or technically conspicuous requests, an unusual accumulation of requests involving identical supporting evidence or other specific indications of false information or circumvention of the contractual conditions. The mere high number of cancellation or refund requests, public criticism of the event, a so-called „shitstorm“ or the simultaneous assertion of the same type of factual reason do not, in themselves, establish suspicion of misuse and do not result in the exclusion of statutory or contractual claims.
7.7 Insofar as this is necessary to carry out the review, processing of an affected request may be temporarily suspended until the requested supporting evidence has been received or until the review has been completed. The Organizer or Höme informs the End Customer of the suspension and the information still required. The review will be carried out within a reasonable period; mandatory statutory deadlines and claims of the End Customer remain unaffected. A request may only be rejected if the asserted claim does not exist under the applicable statutory or contractual provisions, the required supporting evidence is not submitted despite a reasonable deadline having been set, or the requirements for the claim have been falsely represented through intentionally false or knowingly incomplete information.
7.8 If a refund or other payment is wrongfully made as a result of intentionally false or knowingly incomplete information or other deception, statutory claims for repayment, damages and other claims of the respective entitled party remain unaffected. Further measures pursuant to Section 5.4 also remain unaffected. The assertion of such claims requires that the respective statutory requirements are met in the individual case.

8. Liability
8.1 The Organizer has unlimited liability in cases of intent and gross negligence as well as for damages resulting from injury to life, limb or health. Claims under the German Product Liability Act and other mandatory statutory claims remain unaffected. In the event of a slightly negligent breach of material contractual obligations, liability is limited to the foreseeable damage typically occurring.
8.2 The limitations of liability pursuant to Section 8.1 also apply for the benefit of the Organizer’s legal representatives, employees and other vicarious agents.
8.3 Insofar as Höme acts as representative or vicarious agent of the Organizer, the liability provisions pursuant to Sections 8.1 and 8.2 apply accordingly.
8.4 The limitations of liability pursuant to Section 8.3 also apply for the benefit of Höme’s legal representatives, employees and other vicarious agents. The Organizer is responsible for the performance of the event and any claims arising therefrom.

9. Final Provisions
9.1 These GTC apply to the agreement between the Organizer and the End Customer.
9.2 The law of the Federal Republic of Germany applies, excluding the provisions of private international law and the United Nations Convention on Contracts for the International Sale of Goods (CISG – UN Sales Convention). Statutory provisions restricting the choice of law and governing the applicability of mandatory provisions remain unaffected.
9.3 If the End Customer acts as an entrepreneur when concluding the agreement, the Organizer’s registered office shall be the exclusive place of jurisdiction for disputes with the Organizer, and Höme’s registered office shall be the exclusive place of jurisdiction for disputes with Höme. The statutory places of jurisdiction apply to consumers.
9.4 A consumer is any natural person who concludes the agreement predominantly for purposes that cannot be attributed to their commercial or independent professional activity. An entrepreneur is any natural or legal person or partnership with legal capacity that, when concluding the agreement, acts in the exercise of its commercial or independent professional activity.
9.5 The following applies to End Customers with their registered office, place of residence or habitual residence in the European Union:
The End Customer represents that they have full legal capacity or possess the necessary authority to conclude this agreement.
Neither the Organizer nor Höme is willing or obliged to participate in dispute resolution proceedings before a consumer arbitration body.
9.6 Should any of the foregoing provisions be or become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall not be affected thereby. The same applies if and to the extent that a gap should become apparent. In place of the invalid or unenforceable provision, or in order to fill the gap, an appropriate provision shall apply which, to the extent legally possible, comes closest to what the Organizer and the End Customer would have intended economically had they considered the matter.

10. Further Provisions of the Organizer
The following additional provisions of the Organizer apply:
